1. Introduction

This Privacy Policy outlines how Nebula Automotive collects, uses, and shares the personal information of users who access our website, social media pages, software repositories, and other digital services (collectively referred to as our "Services"). In this policy, "we," "us," and "our" refer to Nebula Automotive. Please read this policy carefully to understand our practices regarding your personal information.

"Personal information" refers to any information that can identify you as an individual, either by itself or in combination with other information. This includes, but is not limited to, your full name, email address, employer, job title, home or physical address, phone number, and other contact details.

2. Data Privacy Framework

Nebula Automotive adheres to the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as established by the U.S. Department of Commerce. We have certified our compliance with these frameworks to ensure the proper handling of personal data from the European Union, the United Kingdom (including Gibraltar), and Switzerland.

Nebula Automotive is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission regarding personal information received or transferred under the DPF.

We are committed to resolving any complaints about our privacy practices and the collection or use of your personal information. EU individuals with inquiries or complaints regarding our DPF policy should contact us first. Unresolved complaints will be referred to JAMS, an alternative dispute resolution provider. If your DPF complaint cannot be resolved, you may invoke binding arbitration for residual claims not resolved by other mechanisms. See Annex I DPF.

Nebula Automotive remains responsible for any personal information shared with third parties for external processing as described in Section 6. We may also disclose your personal information to law enforcement, government agencies, courts, and as required by law.

Providing personal information to us is voluntary. By using our services, you consent to this policy and the collection, processing, and sharing of personal information as described herein. If you disagree with this policy, please do not use our services. We may update this policy at any time, with changes effective ten (10) days after posting the revised policy on our website. Continued use of our services after that period indicates acceptance of the changes.

4. Information We Collect

4.1 Information You Provide

We may collect personal information when you interact with us through our services, including:

  • Identifiers and contact details such as your name, email address, phone number, and employer’s name
  • Resumes, CVs, references, and other job applicant data when you apply for a position
  • Communications and feedback, including questions, bug reports, and messages sent via email, GitLab, or other forums
  • Information shared on social media

If you provide information about others, you must ensure you are authorized to do so.

4.2 Information Collected Automatically

We may automatically collect technical information, including:

  • Your internet protocol (IP) address, browser type and version, time zone setting, browser plug-in types and versions, operating system, platform, and other technical details about your visit
  • Interactions with our website, such as page views and duration
  • Cookies and other local storage tools described in Section 4.3
  • Technical details related to errors encountered

4.3 Information Collected Using Cookies

Our website uses session and persistent cookies to administer access and enhance user experience, collect statistical data, and conduct targeted advertising. Nebula Automotive does not sell your personal information in the traditional sense. However, we may share personal information with third parties through analytics tools for targeted advertising.

8. Children’s Privacy

Our website is not intended for children under 13, and we do not knowingly collect their personal information. If we learn of such collection, we will delete the information. If you believe we have collected information from a child under 13, contact us immediately.

9. Do Not Track (DNT)

Our website does not currently recognize or respond to DNT signals.

10. Privacy Rights for U.S., EU, UK, and Swiss Residents

You may have rights to:

  • Access personal information and the categories of information we collect and the purposes for collection
  • Obtain a copy of certain personal information
  • Request deletion or correction of personal information
  • Opt out of targeted advertising and sales of personal information

Verification may be required based on the sensitivity of the request. You may designate an authorized agent to submit requests on your behalf with proper documentation. We will not discriminate against you for exercising privacy rights.

10.1 California Residents

If you are a California resident, you have the right to request information on how we share personal information with third parties for their direct marketing purposes. We do not share personal information for such purposes.

If you are under 18 and a registered user, California law may permit you to remove content or personal information you have publicly posted. To remove such content or information, specify what you want removed. We will remove it in accordance with applicable law, but removal does not ensure complete or comprehensive removal.

10.2 Nevada Residents

If you are a Nevada resident, Chapter 603A of the Nevada Revised Statutes permits you to opt out of future sales of certain information collected about you. Although we do not currently sell such information, you can submit a request to opt out by contacting us.

11. Security

We implement various security measures to protect personal information. However, no transmission or storage method is completely secure. Contact us with any questions or concerns about our security measures.

12. Information Choices and Changes

You can:

  • Opt out of marketing communications via instructions in emails or by contacting us.
  • Request changes to contact choices, updates to personal information, or account cancellation by contacting us.
  • Manage cookie preferences through your browser settings. Note that blocking or rejecting cookies may affect website functionality.

13. Candidates for Employment

When you apply for a job at Nebula Automotive or our affiliates, we collect and process personal information such as resumes, CVs, and references. This information is used to respond to your application and is stored in compliance with legal requirements.

For applicants outside the U.S., personal information is handled in compliance with the EU-U.S. Data Privacy Framework, the UK extension to the EU-U.S. Data Privacy Framework, the Swiss-U.S. Data Privacy Framework, and the EU and UK General Data Protection Regulation (GDPR).

14. International Data Transfer

Nebula Automotive is headquartered in the United Kingdom, but we operate globally. Information collected from or about you may be transferred to, stored, and processed in any country where we have facilities or engage service providers. Some jurisdictions, including the United States, may not provide the same level of data protection as your home country. By using our website, you consent to such transfers, storage, and processing of information outside your country of residence. We take steps to ensure your information receives adequate protection in these jurisdictions, including through appropriate data processing agreements and data transfer mechanisms.
